Maximum limit for retail sale and individual possession of liquor per Person in Delhi

Delhi Excise Act, 2009 - Section 33 - Delhi Excise Rules, 2010 - Rule 20(a) Maximum limit for retail sale and individual possession of liquor - An individual, aged above 25 years, can possess 9 litres of Indian Liquor and Foreign Liquor, i.e., whisky, vodka, gin and rum, and 18 litres of beer, wine and alcopop 

20. Maximum limit for retail sale and individual possession of liquor The maximum quantities of intoxicants specified below, which for the purposes of the Act, may be sold by retail and possessed exclusively, by an individual not below the age of twenty five years in Delhi, shall be as follows:— 


(a) Indian Liquor and Foreign Liquor  


(i) Indian Liquor and Foreign Liquor (Whisky rum, gin, vodka, and brandy), except    wine liqueur, beer, cider and alcopop;    



nine litres





ii) Wine, beer, liqueur, cider and alcopop; 

 




eighteen litres; 




(iii) Indian Liquor or Foreign Liquor; 




one litre while entering into Delhi from other States; 


(iv) Foreign Liquor 


Two litres while entering into Delhi from other countries

Service when persons summoned cannot be found (provisions under CrPC & CPC)

Section 64 CrPC

 Service when persons summoned cannot be found.—


Where the person summoned cannot, by the exercise of due diligence, be found, the summons may be served by leaving one of the duplicates for him with some adult male member of his family residing with him, and the person with whom the summons is so left shall, if so required by the serving officer, sign a receipt therefor on the back of the other duplicate. 


Explanation .—A servant is not a member of the family within the meaning of this section.


Section 65 CrPC


Procedure when service cannot be effected as before provided.—


If service cannot by the exercise of due diligence be effected as provided in section 62, section 63 or section 64, the serving officer shall affix one of the duplicates of the summons to some conspicuous part of the house or homestead in which the person summoned ordinarily resides; and thereupon the Court, after making such inquiries as it thinks fit, may either declare that the summons has been duly served or order fresh service in such manner as it considers proper.

ORDER V. RULE 15.


Where service may be on an adult member of defendant's family.— 


Where in any suit the defendant is absent from his residence at the time when the service of summons is sought to be effected on his at his residence and there is no likelihood of his being found at the residence within a reasonable time and he has no agent empowered to accept service of the summons on his behalf, service may be made on any adult member of the family, whether male or female, who is residing with him.


Explanation. —A servant is not a member of the family within the meaning of this rule.



ORDER V. RULE 17.


Procedure when defendant refuses to accept service, or cannot be found.—


Where the defendant or his agent or such other person as aforesaid refuses to sign the acknowledgment, or where the serving officer, after using all due and reasonable diligence, cannot find the defendant, 2[who is absent from his residence at the time when service is sought to be effected on him at his residence and there is no likelihood of his being found at the residence within a reasonable time] and there is no agent empowered to accept service of the summons on his behalf, nor any other person on whom service can be made, the serving officer shall affix a copy of the summons on the outer door or some other conspicuous part of the house in which the defendant ordinarily resides or carries on business or personally works for gain, and shall then return the original to the Court from which it was issued, with a report endorsed thereon or annexed thereto stating that he has so affixed the copy, the circumstances under which he did so, and the name and address of the person (if any) by whom the house was identified and in whose presence the copy was affixed.


ORDER V. RULE 20.


Substituted service.—


(1) Where the Court is satisfied that there is reason to believe that the defendant is keeping out of the way for the purpose of avoiding service, or that for any other reason the summons cannot be served in the ordinary way, the Court shall order the summons to be served by affixing a copy thereof in some conspicuous place in the Court-house, and also upon some conspicuous part of the house (if any) in which the defendant is known to have last resided or carried on business or personally worked for gain, or in such other manner as the Court thinks fit. 2[(1A) Where the Court acting under sub-rule (1) orders service by an advertisement in a newspaper, the newspaper shall be a daily newspaper circulating in the locality in which the defendant is last known to have actually and voluntarily resided, carried on business or personally worked for gain.]


(2) Effect of substituted service.—Service substituted by order of the Court shall be as effectual as if it had been made on the defendant personally. 


(3) Where service substituted, time for appearance to be fixed.—Where service is substituted by order of the Court, the Court shall fix such time for the appearance of the defendant as the case may require.

Compounding of Offence as per Sec 320 of CrPC

 1. The offences punishable under the sections of the Indian Penal Code (45 of 1860) specified in the first two columns of the Table next following may be compounded by the persons mentioned in the third column of that Table:

Knowingly selling, or exposing or possessing for sale or for manufacturing purpose, goods marked with a counterfeit property mark. 486 Ditto.
Criminal breach of contract of service. 491 The person with whom the offender has contracted.
Adultery. 497 The husband of the woman.
Enticing or taking away or detaining with criminal intent a married woman. 498 The husband of the woman and the woman
Defamation, except such cases as are specified against section 500 of the Indian Penal Code (45 of 1860) in column 1 of the Table under sub-section (2). 500 The person defamed.
Printing or engraving matter, 501 Ditto.
Sale of printed or engraved substance containing defamatory matter, knowing it to contain such matter. 502 Ditto.
Insult intended to provoke a breach of the peace. 504 The person insulted.
Criminal intimidation. 506 The person intimidated.

2. The offences punishable under the sections of the Indian Penal Code (45 of 1860) specified in the first two columns of the table next following may, with the permission of the Court before which any prosecution for such offence is pending, be compounded by the persons mentioned in the third column of that table:

Cheating and dishonestly inducing delivery of property or the making, alteration or destruction of a valuable security. 420 The person cheated.
Marrying again during the life-time of a husband or wife. 494 The husband or wife of the person so marrying.
Defamation against the President or the Vice-President or the Governor of a State or the Administrator of a Union territory or a Minister in respect of his public functions when instituted upon a complaint made by the Public Prosecutor. 500 The person defamed.
Uttering words or sounds or making gestures or exhibiting any object intending to insult the modesty of a woman or intruding upon the privacy of a woman. 509 The woman whom it was intended to insult or whose privacy was intruded upon.

3. When an offence is compoundable under this section, the abetment of such offence or an attempt to commit such offence (when such attempt is itself an offence) or where the accused is liable under section 34 or 149 of the Indian Penal Code, may be compounded in like manner.


4. —

  1. When the person who would otherwise be competent to compound an offence under this section is under the age of eighteen years or is an idiot or a lunatic, any person competent to contract on his behalf, may, with the permission of the Court compound such offence.
  2. When the person who would otherwise be competent to compound an offence under this section is dead, the legal representative, as defined in the Code of Civil Procedure, 1908 (5 of 1908) of such person may, with the consent of the Court compound such offence.


5. When the accused has been committed for trial or when he has been convicted and an appeal is pending no composition for the offence shall be allowed without the leave of the Court to which he is committed, or, as the case may be, before which the appeal is to be heard.


6. A High Court or Court of Session acting in the exercise of its powers of revision under section 401 may allow any person to compound any offence which such person is competent to compound under this section.


7. No offence shall be compounded if the accused is, by reason of a previous conviction, liable either to enhanced punishment or to a punishment of a different kind for such offence.


8. The composition of an offence under this section shall have the effect of an acquittal of the accused with whom the offence has been compounded.


9. No offence shall be compounded except as provided by this section.
